The Presidency has announced the newly appointed members of the Special Tribunal.
President Cyril Ramaphosa has appointed the tribunal president and judges of the Special Tribunal which has a statutory mandate to recover public funds siphoned from the fiscus through corruption, fraud, and illicit money flows.
The Special Tribunal is a court with similar status to the High Court, established in terms of Special Investigating Unit (SIU) and Special Tribunal Act 74 of 1996, to adjudicate upon civil matters emanating from investigations by SIU and to provide for matters incidental thereto.
President Ramaphosa made these appointments, following consultation with Chief Justice Mandisa Maya.
Spokesperson to President Ramaphosa, Vincent Magwenya said the President has appointed Judge Margaret Victor as Tribunal President for a period of three years, effective Friday, November 1, 2024.
The President has also appointed the following additional judges for a period of three years starting on Friday:
– Judge Thandi Victoria Norman from the High Court in the Eastern Cape Division
– Judge David Makhoba, from the High Court in the Gauteng Division
– Judge Brian A. Mashile from the High Court in the Mpumalanga Division
– Judge Andre Henry Petersen from the High Court in the North West Division
– Judge Chantel Moira Jennifer Fortuin from the High Court in the Western Cape
Special tribunals differ from ordinary civil proceedings which are adversarial in nature. The Special Tribunal adopts a more flexible and expeditious approach to legal actions, its proceedings are inquisitorial in nature and characterised by extensive pre-trial investigations
