Man gets seven years for violating protection order

A 51-YEAR-OLD Northern Cape man was sentenced to seven years of imprisonment by the Upington District Court for violating a protection order obtained against him by the mother of his two children.

The regional spokesperson for the National Prosecuting Authority, Mojalefa Senokoatsane, said the 49-year-old complainant was involved in a relationship with the accused.

“Due to a history of domestic violence, she obtained a protection order on August 2, 2019, prohibiting the accused from any form of abuse, including verbal, emotional, and physical harm,” said Senokoatsane.

“On November 17, 2024, she returned home after staying at a friend’s house. The accused became aggressive, verbally abusing her with vulgar insults and accusations of infidelity. The victim did not engage, walked away, and reported the incident to the South African Police Service (SAPS). The accused was arrested on November 19, 2024, and appeared in court on November 21, 2024.” 

Senokoatsane added that the accused pleaded guilty and was convicted on February 19, 2025.

“During sentencing, State prosecutor Benise Swartz presented evidence that the accused had been convicted twice previously for similar offences against the same victim. On both occasions, he received wholly suspended sentences. The State emphasised that gender-based violence and femicide (GBVF) is a persistent crisis and that women have the right to live without fear or intimidation.” 

Senokoatsane stated that, recognising its duty to protect vulnerable individuals, the court imposed a seven-year direct imprisonment sentence due to the accused’s repeat offences.

In addition, he was also declared unfit to possess a firearm. 

“The NPA commends the prosecutor and law enforcement for their diligence in securing justice in this case. The NPA remains committed to prosecuting GBV-related offences decisively to protect victims and hold offenders accountable,” said Senokoatsane.
